PRIVACY NOTICE

This document constitutes the Privacy Notice (hereinafter the "Notice") of INMOBILIARIA Y SERVICIOS ESPECIALIZADOS CASA CUATRO, S.A. DE C.V., (hereinafter the "Company"), with domicile to hear and receive notices at Davinci 3318, Colonia Aurea Residencial, Mexicali, Baja California, CP 21226; which is made available to you (hereinafter the "Holder") prior to the obtainment and processing of your personal data (hereinafter the “Data”).

The Company recognizes the importance of legitimate, controlled and informed processing of the Data and make this Notice available to you, in order for you to learn Company’s practices to obtain, use, store, and, in general, process your Data, in accordance with the Federal Law for Personal Data Protection held by Private Parties (hereinafter the "Law").

I.- Purpose. .This Notice regulates the form, terms and conditions pursuant to which the Company, including its subsidiaries and related companies, are empowered and authorized by the Holder to obtain, process and transfer Holder’s personal data (hereinafter "Data").

II.- Consent. The Holder hereby declares under oath to tell the truth that:

b) In the event that this Notice is available through audio, visual or through any other technology media, the sole fact that Holder provide its Data constitutes a consent manifestation so that the Company may perform the processing of Holder’s Data in accordance with this Notice.
c) In the event that this Notice is available in writing, Holder’s signature, rubric, name or fingerprint, constitutes a manifestation of consent so that the Company may perform the processing of Holder’s Data in accordance with this Notice.

IV.- Use of Data. Your Data will be used to perform ordinary commerce functions related to the Company's business, as well as all activities and procedures that may arise from the relationship that may be established between the Company and you.

Among these functions, enunciatively but not limited to, are:

a) Communicate offers of real estate or Assignment of Trust Rights available for sale;

g) Administration and/or collections;
h) Knowing your opinion and purchase experience and/or feedback of the services.

V.- Sensitive data. The Holder declares under oath to tell the truth, that has not provided and will never provide the Company with "sensitive personal data", i.e. those intimate personal data or Data which its due or undue use, may result in discrimination or involves a serious risk for the Holder.

In particular, the Holder agrees not to provide the Company any Data regarding racial or ethnic origin, present or future health status, genetic information, religious, philosophical and moral beliefs, labor union affiliation, political opinions or sexual preference.

VI.- Data Collection. Holder will voluntarily provide its Data to the Company, whether in writing, verbally or electronically, through surveys, its direct entry to the Company’s website or by sending electronic files or through any other means, including but not limited to direct delivery of information, access to Company’s, or its clients or affiliates websites, phone calls, e-mail requests, product orders, Database filling, etc.

The Holder agrees that the Company may also obtain Holder Data from other means such as information obtained from other available commercially sources, such as telephone directories, labor directories, business cards, public databases, etc. All Holder information and Data that the Company collects may be combined for the purposes permitted under this Privacy Notice.

VII. Storage, disclosure and transfer of Data. Los Datos pueden transferirse, almacenarse y procesarse en un país distinto de donde se proporcionaron, en cuyo caso la Empresa transferirá la información de conformidad con las leyes de protección de la información aplicables.

IX.- Data excluded. El sitio web de la Empresa puede incluir enlaces a sitios web de terceros. Si obtiene acceso a dichos enlaces, abandonará el sitio web de la Empresa, por lo cual la Empresa no asume ninguna responsabilidad en relación con dichos otros sitios web.

The access, correction, cancellation or objection request shall contain and enclose the following:

XII.- Cancellation or Revocation. En caso de solicitudes de cancelación total de Datos o revocación del consentimiento, las mismas deberán realizarse de conformidad con lo señalado en el apartado anterior.
